Egyptian Goddes, Inc. v. Swisa, Inc.大法廷判決を読む3

 Egyptian Goddes v. Swisa大法廷判決は、米国意匠特許権に関し、「新たな侵害判断基準を設定した画期的なものである」と評価されている。例えば、山口洋一郎著「米国CAFCにおける特許制度改革―意匠権のクレーム解釈における公知意匠の役割を明瞭にしたEgyptian Goddes v. Swisa大法廷判決―」(AIPPI(2009)Vol.54 No.1)(以下「山口氏論文」という)を参照。

 本件では、Egyptian Goddes社(以下「EG社」)のネイルバッファー※1に関する意匠特許を、Swisa社のネイルバッファーが侵害するかが問題となった。米国連邦巡回控訴裁判所(Court of Appeals for the Federal Circuit(以下「CAFC」という。))は、一度従来の侵害判断基準に基づき非侵害の判決を出したが、これを取り消し、同大法廷審理を経て、意匠特許権侵害判断の重要な二つのルールを示したという。

※1:日本語で「爪磨き」と訳せようが、片仮名「ネイルバッファー」も日本のこの製品分野では使用されているようなので片仮名で記す。「buffer」も、爪を磨くものとして「バッファー」と、「buffering」も磨くこととして「バッファリング」と、日本で同様に使用されているようなので片仮名で記す。

 本HP1回目では、Egyptian大法廷判決のうち、主に意匠クレーム解釈について言及した第一のルールに関する部分を訳しその意義を考えた。2回目以降は、同大法廷判決のうち、主に「新規な点の基準」を廃し唯一の判断基準として「通常の観察者の基準」に言及した第二のルールに関する部分を訳しその意義を考えたい。まず2回目は、同大法廷判決のうち、従来、意匠権侵害判断の第二の基準と理解されてきた「新規な点の基準(the point of novelty test)」を採用した地裁判決と最初のCAFC判決に触れた部分を訳した。今回は、同大法廷判決のうち、「通常の観察者の基準」を打ち立てたGorham Co. v. White, 81 U.S.511(1871)最高裁判決と、これに「新規な点の基準」を新たに導入したとされているLitton Systems, Inc. v. Whirpool Corp判決に関する部分を主に訳し、同大法廷がこれらの判決をどのように評価したか見ていく。 なお、英文は、Egyptian大法廷判決文(http://www.cafc.uscourts.gov/sites/default/files/opinions-orders/06-1562.pdf)より引用。

Gorham Co. v. White, 81 U.S.511(1871)最高裁判決に関する記載部分

『意匠特許法の議論の出発点は、Gorham Co. v. White, 81 U.S.511(1871)最高裁判決である。本件は、テーブルスプーンとフォークの柄に対する意匠特許に関するものだった。クレーム侵害の分析では、裁判所は意匠の同一性(identity)の基準は"外観の同一性(sameness)でなければならず、図面やスケッチにおける単なる線の違いや...形態におけるわずか変化...は、実質的な同一性を損なうものではない。(省略) 裁判所は、外観の同一性、すなわち目に与える効果の同一性は、意匠の実質的同一性の主な基準であると説明する。この二つは‟専門家の目に対し"同じである必要はない。人間の工夫する力は、細部の全てで、専門家が区別できないような、まったく同じ意匠を生み出すことはないので、専門家の目を基準にすると特許意匠の侵害にはならならいからである。(省略)

原文:The starting point for any discussion of the law of design patents is the Supreme Court's decision in Gorham Co. v. White 81 U.S.511(1871). That case involved a design patent for the handles of tablespoon and forks. In its analysis of claim infringement, the Court stated that the test of identity of design "must be sameness of appearance, and mere difference of lines in the drawing or sketch...or slight variances in configuration...will not destroy the substantial identity." Id. at 526-27. Identity of appearance, the Court explained, or sameness of effect upon eye, is the main test of substantial identity of design"; the two need not be the same "to the eye of an expert," because if that were the test, [t]here never could be piracy of a patented design, for human ingenuity has never yet produced a design, in all its details, exactly like another, so like, that an expert could not distinguish them." 『次に、Gorham裁判所は、その後の多くの事案で引用される判断基準を示した。‟通常の観察者の目で、購入者が通常払うべき注意を払いながら、二つの意匠が実質的に同一であり、一方をもう一方と思って購入するよう誘導し、そのような観察者を欺くほどに似ているなら、特許された先のものは、もう一方のものによって侵害される。"(省略)この事案でそれ以前に、裁判所は、‟装飾上の細部において、原告意匠と被告意匠に何らかの相違があっても、概して外観と効果において未だ同じであり、市場や購入者にとって同じものとして通用するほどよく似ており、取引業者でさえ欺かれるおそれがあるほどよく似ている"と結論づけた。(省略)

原文:The Gorham Court then set forth the test that has been cited in many subsequent cases: "[I]f, in the eye of an ordinary observer, giving such attention as a purchaser usually gives, two designs are substantially the same, if the resemblance is such as to deceive such an observer, inducing him to purchase one supposing it to be the other, the first one patented is infringed by the other." 81 U.S. at 528. In the case before it, the Court concluded that "whatever differences there may be between the plaintiff's design and those of the defendant in details of ornament, they are still the same in general appearance and effect, so much alike that in the market and with purchasers they would pass for the same thing --so much alike that even persons in the trade would be in danger if being deceived." Litton Systems, Inc. v. Whirpool Corp判決に関する記載部分
 
『Gorham判決以来、この事案で裁判所によって明示された基準は、"通常の観察者"の基準と呼ばれ、この裁判所と前裁判所を含む下級裁によって、意匠特許侵害を判断するための適切な基準として認識されている。(省略) しかしながら、Litton Systems、Inc. v. Whirpool Corp., 728 F. 2d 1423 (Fed. Cir 1984)判決を起源とする一連の事案で、この裁判所は、通常の観察者の基準に基づいた類似性の証拠は、意匠特許侵害を構成するのに十分ではないと主張した。そして裁判所は、侵害とみなされるためには、被疑侵害意匠がクレーム意匠の新規性を取り込んでいなければならないと述べている。Litton Systems判決は以下のように述べる。

原文:Since the decision in Gorham, the test articulated by the Court in that case has been referred to as the "ordinary observer" test and has been recognized by lower courts, including both of this court's predecessors, as the proper standard for determining design patent infringement. See, e.g., Blumcraft of Pittsburg v. United State, 372 F. 2d 1014, 1016 (Ct. Cl. 1967); In re Dubois, 262 F. 2d 88, 91(CCPA 1958). However, in a series of cases tracing their origins to Litton Systems, Inc. v. Whirlpool Corp., 728 F. 2d 1423 (Fed. Cir 1984), this court has held that proof of similarity under the ordinary observer test is not enough to establish design patent infringement. Rather, the court has stated that the accused design must also appropriate the novelty of the claimed design in order to be deemed infringing. The court in Litton systems wrote as follows:

  For a design patent to be infringed...no matter how similar two items look, "the accused device must appropriate the novelty in the patented device which distinguishes it from the prior art." That is, even though the court compares two items through the eyes of the ordinary observer, it must nevertheless, to find infringement, attribute their similarity to the novelty which distinguishes the patented device from the prior art.』本文6-7頁


(省略)Litton Systems判決は、新規であるとみなされた意匠の特徴の組合せを特定した後、被告意匠にこれらの特徴がなく、したがって侵害しないと判断した。Litton Systems判決後多くの事案で、意匠特許侵害の判断基準に、通常の観察者の視点とクレーム意匠における特定の新規性の両方を考慮することを要求するために、上記の言葉を解釈している。(省略)

  新規な点の基準がどの程度独立した基準となっているか、この裁判所の判例法では必ずしも明らかではない。Litton判決の直後に出された事案では、裁判所は、通常の観察者の基準と新規な点の基準は"結合的"として記述していた。(省略) 裁判所が、通常の観察者と新規な点の両基準は、"二つの異なる基準"と記述し、新規な点の基準と通常の観察者の基準の混合は法的誤りであると記述するようになったのはかなり最近のことである。(省略)

原文:Litton Systems, Inc, 728 F. 2d 1423 (Citations omitted). After identifying the combination of features in the design that it considered novel, the court in Litton Systems held that the accused design had none of those features and therefore did not infringe. Id. In number of cases decided after Litton Systems, this court interpreted the language quoted above to require that the test for design patent infringement consider both the perspective of the ordinary observer and the particular novelty in the claimed design. See, e.g., Bernhardt, L.L.C. v. Collezione Europa USA, Inc., 386 F. 3d 1371, 1383 (Fed Cir. 2004); Contessa Food Prods., Inc. v. Conagra, Inc., 157 f.3d 1311, 1323-24 (Fed. Cir. 1998); Oakley, Inc. v. Int'l Tropical-Cal., Inc., 923 F 2.2d 167, 169 (fed. Cir. 1991); Avia Group Int'l, Inc. v. L.A. Gear Cal., Inc., 853 F. 2d 1557, 1565 (Fed. Cir. 1988).

  The extent to which the point of novelty test has been a separate test has not always been clear in this court's case law. in cases decided shortly after Litton, the court described the ordinary observer test and the point of novelty test as "conjunctive." See, L.A. Gear, Inc. v. Thom McAn Shoe Co., 988 F.2d 1117, 1125 (fed.Cir.1993); Shelcore, Inc. v. Durham Indus., Inc., 745 F.2d 621, 628 n.16 (Fed. Cir. 1993). It has not been until much more recently that this court has described the ordinary and point of novelty tests as "two distinct tests" and has stated that "[t]he merger of the point of novelty test and the ordinary test is legal error." Unidynamics Corp., 157 F.3d at 1323-24; see also Lawman Armor Corp. v. Winner Int'l LLC, 437 F.3d 1383, 1384 (Fed. Cir. 2006); Contessa Food Prods., Inc., 282 F.3d at 1377; Sun Hill Indus., Inc. v. Easter Unlimited, Inc., 48 F.3d 1193, 1197 (fed Cir.1995).』本文7-8頁

 
『新規な点の基準の位置付けるについて違いがあっても、クレーム意匠が、単一の先行意匠文献に基づき、単一の点で先行意匠文献から出発するような単純な事案では、合理的で簡単に適用できることが証明されている。そのような事案では、新規な点を特定し、被疑侵害意匠が、先行意匠で既にあるクレーム意匠の態様を複製するのではなく、新規な点を取り込んでいるかを決定することは単純な問題である。しかし、意匠クレームが新規な点とみなされ得る多数の特徴を有する場合や、複数の先行意匠文献が公表されており、クレーム意匠が先行意匠文献の一つ以上において見出される各特徴の組合せからなる場合に、新規な点の基準を適用するのは難しいことが証明されている。特に、複数の特徴や複数の先行意匠文献が関係してくる新規な点の基準を適用すると、特徴の組合せや、意匠の言語的表現がクレーム意匠の新規な点を構成できるか否かについて見解の相違が生じた。(省略) 新規な点の基準の地位と適用を取り巻く問題を踏まえると、意匠特許法全体における新規な点の基準の場を再考する手段としてこの事案を用いる。

原文:Regardless of the differences in the way it has been characterized, the point of novelty test has proved reasonably easy to apply in simple cases in which the claimed design is based on a single prior art reference and departs from that reference in a single respect. In such cases, it is a simple matter to identify the point of novelty and to determine whether the accused design has appropriated the point of novelty, as opposed to copying those aspects of the claimed design that were already in the prior art. However, the point of novelty test has proved more difficult to apply where the claimed design has numerous feature that can be considered points of novelty, or whether multiple prior art references are in issue and the claimed design consists of a combination of features, each of which could be found in one or more of the prior art designs. In particular, applying the point of novelty test where multiple features and multiple prior art references are in play has led to disagreement over whether combinations of features, or the overall appearance of a design, can constitute the point of novelty of the claimed design. <ひとまずHP筆者の感想など>

 本HP筆者としては、Gorham判決以来、侵害事件における主要な判断基準とされてきた"通常の観察者"の基準は、対比する両意匠の各部分にとらわれず、全体観察を原則とする点で共感できる。主体的要件を、デザインの専門家ではなく、通常の観察者とし、主にその製品分野の購入者と設定するのも、製品のターゲット層とほぼ一致した考え方で納得できる。しかし、当該製品分野の形態の流れを見ないで、市場における両意匠に係る製品を「混同」して購入するか否かで両意匠の類否を決するのは、いわば商標法的な考え方で抵抗がある。従って、第二の判断基準として「新規な点の基準」を導入すべきとしたLitton Systems判決も、当該製品分野の形態の流れを見ようとする趣旨と理解するなら、共感できる。そうすると、なぜ、Egyptian大法廷判決では、「新規な点の基準」を廃したのだろうか、と思いながら読み進めてきた。

 以上をみていくと、本HP筆者としては、Egyptian大法廷判決が、実質的に「新規な点の基準を廃した」とまでは言えないように思う。但し、「第二の判断基準として」の「新規な点の基準を廃した」とは言えるだろう。すなわち、同大法廷判決は、過去の判決を検討しながら、「通常の観察者の基準」と「新規な点の基準」は当初独立したものではなく、独立したものと把握されたのはつい最近のことであるとし、そして、独立させることで生じる問題を指摘し、いまいちど、これらを統合して、一つの判断基準を打ち立てるべきと判断したものと考える。
 
 ここで、本HP筆者として、新規な点の基準を適用する問題点をまとめると、以下のようになる。

(ア) 特許意匠に、新規な点と考えられる特徴が複数ある場合、対比する意匠が類似か否かを判断する際、最終的に全体観察を行うことを原則とすると、これをどう評価するかが問題となると思う。なぜなら、新規な点が複数あると、特許の請求項のように、その複数がA+B+Cのように組み合わさって、これら全ての結合が特許意匠の特徴と解され、かえって意匠権の効力範囲が狭くなってしまうことが大きな問題と考えられる。

もっとも、本件の原告の主張のように、Naico特許(いわばA+B+C)の存在を無視して(又は知らないで)、特許意匠のいわば「A+B+C+D」全体が新規な点であるとし、「A+B+C+E」を構成要素とする被疑侵害意匠について、DとEは微細な相違なので意匠権の効力範囲に含まれるとするなら、意匠権の効力範囲はむしろ広くなり、この場合も問題となろう。

(イ) 一方、特許意匠において特徴的部分が、A+B+Cのように組み合わさって把握される場合に、A、B、Cそれぞれは、各先行意匠文献に表されている場合、これの組合せ全体を新規な点として認めてよいのか、新たな意匠的効果が生じている場合でも認められないとすると、この場合も、意匠権の効力範囲が狭くなってしまうことが大きな問題と考えられる。

すなわち、本件について、A、B、Cそれぞれが各先行意匠文献に表されていても、Nalico特許が存在しなかったなら、「A+B+C」の結合の意匠効果が特徴的であると認められる可能性があり、その場合は、被疑侵害意匠は意匠権の効力範囲に含まれるとしても妥当な結論が導かれ得る。この場合、A、B、Cそれぞれが各先行意匠文献を理由に新規な点であると認められずDとEの相違により、非類似とすると問題となろう。
